USER AGREEMENT (Payment Rules)
This User Agreement (the “Agreement”) governs relations between Vinspec LTD (the “Contractor” or the “Service Owner”) and the individual using the Service (the “User”).
1. General provisions
1.1. The Contractor may unilaterally change this Agreement without special notice. The new version comes into force from the moment it is published on the website. Continued use of the Service means acceptance of such changes. If the User disagrees, the User must stop using the Service.
1.2. The Service uses GMT+3 time to record payment date and time.
2. Services and internal balance system
2.1. The Service provides information services for vehicle data checks by VIN and other identifiers.
2.2. The Service uses an internal balance (the “Balance”) expressed in points. 1 point equals 1 USD.
2.3. The User tops up the Balance with one-time payments via payment systems. Each top-up requires an active action (amount selection, details entry, and 3D-Secure confirmation where applicable). The top-up service is considered provided once points are credited to the Balance.
2.4. The cost of an information service is debited from the Balance only after User confirmation.
2.5. The Service does not use subscriptions or recurring automatic payments. Bank card data is not stored.
3. Acceptance of the terms of the Agreement
By making a payment (clicking the “Pay” button), the User confirms that:
- has read the Agreement and accepts it in full;
- understands the difference between topping up the Balance and paying for a specific service;
- understands that points are deducted only by their own action.
4. Rights and obligations of the Service Owner
4.1. The Contractor has the right to:
- determine the scope of services, structure, and visual presentation of the Service;
- restrict or block access in case of suspected unauthorized use;
- suspend Service operation for technical or organizational reasons until such reasons are resolved.
4.2. The Contractor undertakes to take reasonable measures to resolve issues, but is not responsible for:
- information on third-party websites linked from the Service;
- Internet outages, malware actions, telecom operator failures, or bad-faith actions of third parties.
5. Payment security and privacy
5.1. Payment is made through secure payment pages in accordance with Visa and MasterCard requirements. Card data is encrypted.
5.2. All payment actions performed with the User’s card are considered performed by the User. If access to a card or account is lost, the User must independently take protective measures (contacting the bank, password change, etc.).
5.3. The User confirms lawful card usage, legal capacity, and awareness of payment terms.
6. Refund
6.1. Unused points: The User may request a refund of unspent points at any time (minus actual Contractor expenses, including payment system and bank fees). To request a refund, send an email to admin@vin-spec.com with User ID, payment date, and payment amount.
6.2. Spent points: Points debited for already provided information services are non-refundable.
6.3. Refunds are made to the same card used for payment within up to 21 business days from receipt of the request.
6.4. In case of technical errors, refunds are processed upon request with supporting documents.
7. Data Disclaimer
7.1. The Contractor does not guarantee absolute accuracy, completeness, or timeliness of data received from third parties (manufacturers, government agencies, dealers, etc.). If inaccuracies are found, the User agrees that the sole remedy is refund of the cost of the specific report.
8. Denial of service
The Contractor may deny service (including account blocking) to a User who violates this Agreement, demonstrates abusive behavior, or spreads false information about the Service.
9. Force majeure
The Contractor is not liable for failures caused by force majeure circumstances, including internet disruptions, access blocking, and third-party equipment failures.
10. Final provisions
10.1. This Agreement enters into force when the User starts using the Service and remains valid until terminated by either party.
